ARTICLE 1 PREAMBLE

1-1 MOODESIGN COMPANY

MOODESIGN LTD is a company by Mauritian law, registered with the Registrar Of Companies (ROC) under the license 117599 whose registered office is at 20 Feet Road, Grand Baie.

Offices: 20 Feet Road, Grand Baie. – Opening hours Monday to Friday from 9 to 16:30.

Any order validated by any user (hereinafter “User”, “Customer” or “You”) on the Site “MOODesign.mu” implies the prior acceptance of these terms and conditions.

1-3 PURPOSE OF THE TERMS AND CONDITIONS (GTC)

These terms are intended to define the rights and obligations of parties under the online sale of goods and services offered by “MOODesign.mu” to the Client.

These terms and conditions are written in English and express obligations, rights of the Customer and MOODesign. In this sense, the Customer acknowledges and accepts without reservation all the provisions of these Conditions of Sale. MOODesign agrees reciprocally to respect the obligations under the present.

ARTICLE 2 PRODUCTS

PRODUCT INFORMATION

Products offered by MOODesign comply with the Mauritian legislation and standards.

However, if a product were to be taken off the market for any reason by the Supplier MOODesign withdraw the product from sale as soon as possible. This action can not in any way give any right of action in favor of the Customer.

MOODesign strives to provide the best products on the cards, the essential characteristics of these. The information submitted by MOODesign are those provided by the supplier.

ARTICLE 3 PRICES AND VAT

3-1 PRICE

ARTICLE 4- AVAILABILITY

AVAILABILITY DATES

8-12 weeks: available at our Supplier or manufactured on demand, the shipping time is 8 to 12 weeks.

Availability: the product is new, its marketing and its availability will be at the specified date (eg 15/12/2015)

These limits shall be from the date of confirmation of payment on the site MOODesign.mu.

In the case of unavailability of the product ordered, MOODesign will contact the customer by email or phone to indicate the delivery time.

ARTICLE 5. ORDER

5-1 ORDERING

To place your order, we offer you three ways:

The control process is composed of four (4) successive stages.

– Choose your mode of settlement,

ARTICLE 6 PAYMENT ONLINE

6-1 SECURE PAYMENT

6-2 CONDITIONS

To reduce the risk of fraud and to protect the interests of its Customers, MOODesign must sometimes carry out checks on the validity of payments made.

In the case of a control, the customer is notified by email of the supporting documents to be sent (by email or mail) to Customer Service MOODesign to allow them a final confirmation of his order

Following this examination, if any:

– MOODesign reserves the right to accept or reject the Order,

– In case of non receipt of the supporting documents within 48 hours MOODesign reserves the right to refuse payment validation and thus reject the Order

– If you receive documents deemed non-compliant by the Customer, MOODesign reserves the right to reject the Order.

ARTICLE 7 MODES OF DELIVERY

7-1 CARRIER

Our products are delivered directly to your home via a specialized carrier. Thus the guarantee of quality delivery.

7-2 DO ON DELIVERY

When you receive a package, check well in the presence of the deliveryman, the condition.
– It is necessary to control the content of the parcel in the presence of the deliveryman.
Warning: risks related to transport are covered under the condition that the purchaser checked the goods upon arrival and has exercised, if appropriate, its action against the carrier within time frame indicated by the supplier Moodesign Ltd.

ARTICLE 8 CUSTOMER SATISFACTION

You must be completely satisfied with the products and services that are offered by MOODesign.mu!

That’s why we bring systematically to each customer and for each order the maximum care. However, it is possible that the product you receive does not match what you expected.

In this case, the returned merchandise must be justified. MOODesign Ltd. will judge to exchange or refund a product that does not satisfisfait you.

The process to follow:

Items returned must be in their packages or cartons unopened, with no trace of use, with all the accessories, manuals and documentation. Items returned incomplete, damaged or soiled by the Customer are not taken. You can send your package, accompanied by the invoice to:

The return costs are your responsibility.

– When returning the product between the eighth and fifteenth days, the refund will be in the form of credit valid for 15 days on the website of MOODesign.mu

ARTICLE 9. GUARANTEES PRODUCTS

9-1 LEGAL GUARANTEES

The products sold by MOODesign benefit from the legal guarantee of conformity and the guarantee against hidden defects.

9-2 MANUFACTURER WARRANTY

The products sold are guaranteed manufacturer whose scope and duration differ between products and brands.

The manufacturer guarantees the products marketed by MOODesign do not cover:
– Replacement of consumables (batteries, bulbs, fuses, …)
– Abnormal or improper product use.
– Damage due to the intervention of a repairer not approved by MOODesign
– Damage resulting from a cause external to the product (for example, accident, shock, lightning, a power fluctuation …)

In all cases, MOODesign can not be held responsible if the manufacturer refuses to apply its guarantee for the reasons set out above.

In case of no support for the repair, the manufacturer will establish a quote.

ARTICLE 10- PROTECTION OF PERSONAL DATA

PERSONAL INFORMATION

The information collected by MOODesign in any order by a Customer is necessary for the proper management of this Order.

In accordance with the Data Protection Act No. 78-17 of 6 January 1978, the Customer has a right of access, rectification, opposition and deletion of personal data concerning him by writing a letter, with proof of its identity, MOODesign, Customer Service, 20 Feet Road, Grandbaie. ARTICLE 11 DISPUTES

PROCEDURE

In case of dispute, the parties will seek an amicable solution to any disputes arising from the execution of these Conditions of Sale.
Failing amicable settlement, the dispute will be submitted to the Mauritian law and each party gives exclusive jurisdiction to the competent courts.
