General Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTCS) apply to all sales of furniture and furniture-deco packs concluded between MOODESIGN LTD, a company registered in Mauritius under BRN C13117599, with its registered office at Motorway M2, 31301 The Vale, hereinafter referred to as “the Seller,” and any individual or legal entity making a purchase in-store, hereinafter referred to as “the Customer.”

Article 1 : Purpose

1.1 General Definition
These GTCS govern the sale of furniture (indoor and outdoor), decorative items, and furniture-deco packs (some items of which may be supplied by third parties) carried out in the Seller’s showroom at Motorway M2, 31301 The Vale. They specify the conditions for ordering, payment, delivery, warranties, and after-sales service.
1.2 Definition of Customer Categories
The Seller distinguishes two categories of customers :

  • Furniture-Deco Pack Customer : Any customer, individual or legal entity, who equips their entire home (all main rooms, including living room, bedrooms, kitchen, dining room, terrace) exclusively with the Seller’s products (some items of which may be supplied by third parties).
  • Individual Customer : Any customer, individual or legal entity, who purchases the Seller’s products without equipping their entire home with them.

Article 2 : Acceptance of the GTCS

The Customer acknowledges having read and accepted these GTCS prior to placing an order by signing the quote. The GTCS are available in-store upon request.

Article 3 : Product Characteristics

3.1 Seller’s Products
The Seller provides detailed information on products manufactured or directly supplied by them (dimensions, materials, color, price, delivery fees, lead times), available on labels, descriptive sheets, or through staff.
3.2 Furniture-Deco Packs
The packs include the Seller’s products and items (e.g., mattresses, household appliances) that may come from third-party companies. Third-party products are subject to their respective suppliers’ warranty conditions.

Article 4: Order

4.1 Placing the Order
For furniture-deco packs and out-of-stock products, the order is formalized by signing a quote detailing the products and accompanied by an 80% deposit of the total price. The balance is payable upon delivery.
For in-stock products, 100% of the total price is payable upon signing the quote.
4.2 Confirmation
The Seller provides the Customer with a copy of the signed quote, constituting confirmation of the sale. The sale is final after the deposit is received. An invoice is then issued to the Customer.
4.3 Cancellation
No cancellation of orders including custom-made furniture is possible after signing the quote, except with the Seller’s express agreement. In case of accepted cancellation, the deposit remains with the Seller to cover incurred costs.

Article 5 : Prices

Prices are indicated in Mauritian Rupees (MUR), all taxes included, and include delivery and installation. The Seller may modify prices at any time, but products are invoiced at the price indicated at the time of the order.

Article 6 : Payment

Payment can be made by:

  • Cash
  • Bank card (Visa, MasterCard, etc.)
  • Juice
  • Cheque (subject to clearance)
  • Bank transfer

Article 7 : Delivery

7.1 Terms
Delivery and installation are carried out at the address provided by the Customer, in the designated rooms. Installation includes some exceptions (e.g., wall or ceiling fixings). The Customer must verify accessibility (stairs, doors) and report any constraints before ordering.
7.2 Delivery Times and Date
Delivery times indicated on the quote are estimates. Delays do not entitle the Customer to damages.
The delivery date is agreed upon between the Seller and the Customer by phone or email.
7.3 Receipt
The Customer must check the condition of the products upon delivery. In case of damage or non-conformity, they must note precise reservations on the delivery note (e.g., “broken leg,” “torn fabric”) and refuse the damaged product. Any complaint must be addressed in writing to the Seller at contact@moodesign.mu or in-store within 3 days following delivery.
7.4 Storage Fees
If the Customer is unable to accept delivery on the agreed date for reasons attributable to them (absence, unprepared premises, refusal of receipt, etc.), storage fees will be charged. These fees amount to 2% of the total invoice per week of storage, beyond 6 months for Furniture-Deco Pack Customers and 2 months for Individual Customers, unless otherwise agreed by the Seller. The Seller will inform the Customer in writing (email or letter) of the application of these fees. Storage fees must be paid before the new delivery attempt.

Article 8: Legal Warranties

In accordance with the “Sale of Goods Act” and the “Consumer Protection Act”, the Seller guarantees :
– Conformity : Furniture and items must match the description and be fit for the intended use. In case of non-conformity, the Customer may request repair, replacement, or refund, subject to legal conditions.
– Hidden Defects : The Seller is liable for hidden defects rendering the product unfit for use. The Customer may request cancellation of the sale or a price reduction within legal deadlines.
Claims must be made within a reasonable time after discovering the defect, accompanied by proof of purchase. For third-party products included in the packs, legal warranties apply through the Seller, who reserves the right to redirect the claim to the relevant supplier.

Article 9 : After-Sales Service - Contractual Warranty

The Seller offers a 6-month contractual warranty from the delivery date, covering exclusively manufacturing or material defects in furniture manufactured or directly supplied by the Seller, subject to proper use. “Proper use” refers to usage in accordance with provided instructions (e.g., avoiding prolonged exposure to sunlight or humidity, not overloading).
9.1 Terms
– The Customer must report the defect in writing to contact@moodesign.mu or in-store, with a photo of the defect and the order form.
– The Seller reviews the request and, if the defect is covered, offers repair, replacement, or partial refund, at its discretion.
– Transport costs for returns under the After-Sales Service are borne by the Customer, unless otherwise agreed.
9.2 Exclusions
The contractual warranty does not cover:
– Decorative items or products supplied by third-party companies included in furniture-deco packs (these products are subject to their respective suppliers’ warranties).
– Damage due to misuse or negligence.
– Normal wear and tear (e.g., scratches, discoloration).
– Defects caused by abnormal conditions (e.g., excessive humidity, termites).
– Repairs carried out by unauthorized third parties.

Article 10: Personal Data Protection

The Customer’s personal data (name, address, phone number) are collected for order processing and warranty management. They are protected in accordance with the Data Protection Act 2017. The Customer may request access, rectification, or deletion of their data by contacting [email address or store].

Article 11: Force Majeure

The Seller is not liable for delays or failure to perform due to force majeure (e.g., cyclone, national strike), as defined by Mauritian law. If the situation persists beyond 2 months, the contract may be terminated by either party.

Article 12: Disputes

These GTCS are governed by Mauritian law. In case of a dispute, the Customer may submit a written complaint to the Seller at contact@moodesign.mu or in-store. If no amicable resolution is reached, the dispute will be brought before the competent courts of Mauritius. The Customer may also contact the Consumer Affairs Unit for mediation.
